The historic Humphrey Case - participated arguing at the state level in Humphrey resulting in CA Supreme Court establishing a new standard in bail reform that all CA abides by.
In re Humphrey (11 Cal. 5th 135) is a landmark 2021 California Supreme Court ruling that deemed it unconstitutional to detain individuals solely because they cannot afford money bail. Judges must now consider a defendant’s ability to pay, prioritize non-monetary alternatives, and hold hearings to ensure bail is not merely used for detention.
It was an honor to be given this case assignment. The victim was particularly vulnerable, and suffered enough in his late age that he could not appear in court himself for this bail motion. Ms. Burris, with a room full of reporters and journalists from every news media outlet in the Bay Area and beyond, argued the bail request opposition motion given the danger that would have endangered the local communities.
The case went up to the California Supreme Court. The Justices set the standard for litigating bail request in the state of California. Ms. Burris worked on the case from it’s until it resolved. The San Francisco District Attorney's Office trusted Ms. Burris to provide input that the Office followed on what would be a fair outcome in the case
